These Terms of Service (“Terms”) are an agreement between you and Together Won LLC (“TogetherWON,” “we,” “us,” or “our”), a personal training company based in Colorado, USA. They apply to our website, our mobile app, and the training services we provide in your home, at our studio, and online (together, the “Service”). By using the Service, you agree to these Terms and to our Privacy Policy. If you don’t agree, please don’t use the Service.
1. Health and medical disclaimer
TogetherWON provides fitness training and general health education, not medical care. Our trainers are certified fitness professionals, not doctors, physical therapists, or dietitians. Nothing on our website, in our app, in our emails, or in a training session is medical advice, a diagnosis, or a substitute for care from your own health care providers.
- Talk with your doctor first. Check with your doctor before you start any exercise, nutrition, or supplement program, especially if you have heart disease, high blood pressure, diabetes, osteoporosis, a neurological condition, a recent surgery or injury, or a history of falls.
- Stop if something feels wrong. Stop exercising right away if you feel chest pain or pressure, dizziness, faintness, unusual shortness of breath, or sharp pain. Call 911 in an emergency.
- Self-tests are screenings, not diagnoses. Our free self-tests, like the chair stand and grip strength tests, and checklists like the fall-risk check, can point to something worth discussing with your doctor. They can’t tell you whether you have a medical condition.
- Exercise at home safely. When you follow workouts from our website, app, or videos on your own, choose a clear, well-lit space, use sturdy support for balance work, and only do what feels safe for you. Have someone nearby if you’re unsteady.
- Tell us about your health. Let your trainer know about any health conditions, medications, or changes in how you feel, so we can adjust your program. We may ask you to complete a health questionnaire or get your doctor’s clearance before you train with us.
Exercise carries some risk of injury, even when it’s done carefully. By using the Service, you understand that risk and choose to take part voluntarily.
2. Who can use the Service
The Service is for adults 18 and older. If you create an app account, you’re responsible for keeping your login details secure and for activity under your account. Caregivers, family members, and workout partners you invite to the app must follow these Terms too.
3. Training services
- Consultations. Your first one-hour consultation is free and doesn’t commit you to anything.
- Plans and prices. Our plans and prices are listed on our pricing page. Plans are month to month, with no long-term contract. In-home sessions more than 30 miles round trip add $5 per session. We may change our prices, and we’ll tell current clients before a change affects them.
- Scheduling and missed sessions. Please let your trainer know as early as you can if you need to reschedule. Your trainer will explain our scheduling and missed-session policy when you sign up.
- Cancelling. You can stop your plan by letting us know before your next month begins.
- Training in your home. For in-home sessions, please provide a safe, clear space to exercise. We may end or reschedule a session if conditions aren’t safe.
- Care partners. When a caregiver, including a professional caregiver from a home care provider, helps you exercise between sessions, they do so as your helper, not as our employee or agent. Your trainer will show them how to help, but they’re responsible for their own actions.
4. Using our app and website
We give you a personal, non-transferable right to use our app and website for your own training. Please don’t copy, resell, or misuse the Service, try to access accounts or systems that aren’t yours, or use the Service in a way that breaks the law or harms others. We may suspend accounts that do. We work to keep the Service available, but it may sometimes be unavailable or change.
5. Our content
Our articles, guides, recipes, videos, workout programs, photos, logos, and app content belong to TogetherWON or the people who license them to us. You’re welcome to use them for your own personal training and to share links to them. Please don’t republish, sell, or use them commercially without our written permission.
6. Client stories and testimonials
We share client stories, quotes, and photos only with the client’s permission. Results vary from person to person, and a client’s experience isn’t a promise of the results you’ll get.
7. Links to other websites
Our website links to other sites, such as research sources, our partners, and video platforms. We don’t control those sites and aren’t responsible for their content or privacy practices.
8. Disclaimer of warranties
We provide the Service “as is” and “as available.” To the fullest extent the law allows, we make no warranties, express or implied, including that the Service will meet your goals or be error-free.
9. Limitation of liability
To the fullest extent the law allows, TogetherWON and its owners, trainers, and contractors aren’t liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability for any claim related to the Service is limited to the amount you paid us in the three months before the claim arose. Nothing in these Terms limits liability that can’t be limited under Colorado law.
10. Governing law
These Terms are governed by the laws of the State of Colorado. Any dispute will be handled in the state or federal courts located in El Paso County, Colorado.
11. Changes to these Terms
We may update these Terms from time to time. We’ll post the new version here and change the “Last updated” date at the top. If you keep using the Service after a change, you accept the updated Terms.
